Terms & Conditions
Patrons should be aware that all orders accepted are done so on the understanding that our terms and conditions as set out here in this document are agreed.
Placing your order
You can place your order in several ways - through our online ordering system, by phone, email or post. We will make every effort to ensure that all of these methods are fully operational at all times. We cannot be responsible for delays or losses caused by failures of any of the above methods.
Order payments:
We take all reasonable care to keep the details of your payment secure. In the absence of negligence on our part, we cannot be held liable for any third party procuring unauthorised access to any data you provide when ordering or otherwise dealing with us.
Full payment must be made prior to the manufacture of goods.
All items remain the property of the seller until they are paid for in full.
We reserve the right to cancel any order. Non-acceptance of an order may be as a result of one of the following:
- The product you ordered being unavailable from stock, or if a custom made product, is beyond our ability to make as you require;
- Our inability to obtain authorisation for your payment;
- The identification of a pricing or product description error;
- Or we believe the order to be suspect or fraudulent in any way.
Orders are only processed once payment has been received.
A contract is only entered into between Gabitie Structures and you, the customer, once your goods have been delivered. The processing of a payment and acknowledgement of an order does not constitute a legally binding contract.
Our quotation does not include a Main Contractor's Discount. If a 2.5% Main Contractor's Discount is applicable, please add 3% to our quoted prices.
Minimum order conditions:
We only accept orders for complete buildings. We do not sell parts of buildings.
Bespoke Manufacture of Goods- this service is designed to allow customers to request a specific product not shown on our standard product list. We will work off customers drawings or specifications. Once manufacture has commenced, any changes or alterations requested will be charged on an additional basis. Cancellations will only be accepted once all our costs have been covered by the customer.
Quotations
Any quotation is valid for 30 days only from its date, provided that the Company has not previously withdrawn it.
Cancellation
We are reliant on the correct measurements supplied by you. All our products are custom made to individual requirements and are therefore non-returnable, except for faulty manufacture but see our returns policy.
Cancellation of an order for custom made products is not possible once the order has been agreed upon.
If you wish to cancel your order, contact us immediately. If goods have been despatched our 'returns policy' applies. Please note, it takes time to manufacture and deliver your product. If the manufacture of your order has already commenced, then relevant 'Direct Cost Charges' will be applied, under our 'Returns Policy', to any applicable order refund.
Delivery
All stated delivery times are for the UK mainland delivery to the Highlands of Scotland, Europe, and Elsewhere may take longer. Tracking information, where applicable, is sent out before goods are due to be delivered.
Although we will make every effort to deliver on the date in the contract as promised, a delivery time can't be specified. We will not be held liable for any loss or damage resulting from any delay or error in the delivery beyond our control.
Whilst we will do all we can to ensure that the correct goods are delivered, it is the buyer's responsibility to ensure they have received the correct items, within three days of receipt.
We will arrange delivery of the goods at the earliest opportunity, subject to the order value being paid in full (and cleared). Usually within 35 days of receipt of funds, but this may vary between product ranges. We cannot guarantee specific delivery dates or delivery times and cannot be held responsible or deemed in breach of this agreement for delays that are out of our direct control including, (but not limited to) manufacturing problems and third party contracted companies. We will, however, try to rectify any issues as quickly as possible.
We shall not be responsible for any delays caused due to incorrect or incomplete information being submitted by 'The customer'. It is your responsibility to ensure that correct delivery details, including a valid postcode, have been entered. We will not and cannot be held responsible for delays or lost orders; caused as a direct result of user input error on your part. Goods without a valid postcode cannot be dispatched. Please note: we also reserve the right to only deliver to the billing address.
Deliveries shall be made to the roadside only; however, the delivered goods may be moved to an alternative point at the delivery address, at the driver's discretion.
Individual panels can be large and bulky. It is your responsibility to provide appropriate access for the delivery and notify us of any concerns, in writing, at the point of order. If we are unable to fulfil the delivery in this instance, you will be liable for any failed or return delivery charges.
All orders are delivered on a signed service, meaning that someone must be available to accept delivery. If you or your representative is not available to sign for the goods upon delivery, you will be liable for the failed and/or return delivery charges.
Please note that by signing for a delivery you are signing to say that goods are received in good condition- if they are not then you should sign as 'Goods damaged' on delivery or 'Goods not inspected'. Should we find that we are unable to deliver goods for reasons, not of our or the couriers making; an additional delivery charge will usually be applied to re-deliver.
Goods must be examined within 24 hours of delivery, and all damages or shortages must be reported as soon as possible by telephone to 0845 365 8 007, and thereafter in writing. Gabitie Group Ltd will not accept any telephone claims which are not backed up immediately in writing with supporting pictures.
No responsibility for transit damage will be accepted after 24 hours from the time of delivery. If sectional goods/panels are missing, incorrect or if damage has occurred during transit, each section will be classed as an individual item. We reserve the right to replace only the damaged or missing sections and can decline any replacement when damage has been caused by 'The Customer' through misuse, neglect, self-assembly, or incorrect storage. Minor superficial damage caused during transit or missing parts will not be accepted as grounds for rejection.
You should not begin the installation or arrange any third-party installation until the product has been fully inspected for damage or missing parts. We shall not be liable for any costs incurred by 'The Customer', should they fail to inspect and satisfy themselves that the product is sound and complete before self-assembly.
Shipping
There is usually no additional charge for delivery within 145 miles of WV2 2RL. You can get a quote in the shopping cart for shipping outside this area by inputting your postcode. Any queries please contact us.
Delivery terms:
If your order is dispatched by courier it can be delivered anytime between 8 am and 8 pm local time. We will always endeavour to advise customers which date to expect their delivery. Where possible, we will include your phone number on consignment paperwork; however, we can't arrange specific delivery instructions with courier drivers.
If your order is dispatched using our vehicles, we will advise you of the exact day and can usually give you a good time frame when to expect us. We are also able to take more specific delivery instructions. If you are not in when we attempt delivery, your order will be returned directly to us, and an extra delivery charge will be added to your order.
Goods returned to us because they were unable to be delivered will incur an additional delivery charge, equivalent to the actual cost of delivery.
Assembly Terms:
As outlined in our delivery service assembly is usually started within 1-15 working days of the quoted fabrication completion date, if an assembly is not confirmed at the time of fabrication order this may be longer due to the availability of our assembly team.
Payment:
If you pay by cheque, we will commence manufacture of the goods once the cheque has cleared. Please make cheques payable to 'Gabitie Group Ltd' and post to the address below.
To prevent possible fraud with your money, we may ask for evidence of account ownership before manufacture is initiated, (typically on orders which are high value or questionable).
Should you wish to pay by credit card a 5% charge will be added to your order.
You can elect to pay a 50% deposit with the remaining balance due before your order is shipped. We will notify you, usually by email, to confirm that the balance is due. You will then have 7 days to process the payment. After this, a storage charge of 2.5% of the order total will be added per week, at our discretion, to your balance until full funds are received.
Product Descriptions
The seller attempts to be as accurate as possible. If a product offered is not as described, your sole remedy is to return it in unused condition. Please contact us to discuss your case.
Technical Specifications and Advice
Wherever possible we try to provide accurate advice on our products, based on our experiences. Our guidance is however given without any liability. We do not proclaim to be experts nor hold any certification or qualification in any trade relating to the installation or use of our products. Ultimate responsibility for the safe installation and use of any of our products, therefore, lies with the buyer and we will not be held liable for any loss or damage resulting from our guidance.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activities that occur under your account or password.
Indemnity
You agree fully to indemnify, defend and hold us, and our officers, employees, agents and any personnel of 'Gabitie Group Ltd' harmless immediately on demand, from and against all claims, liability, damages, losses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other person accessing the Website using your name and/or personal information.
Our rights
We reserve the right to:
- Modify or withdraw temporarily or permanently, this Website (or any part of it);
- Change the Terms and Conditions from time to time, and your continued use of the Website following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed;
- To modify prices, descriptions or any other information of our products or other published data;
- To refuse an order, in which case any cleared funds would be returned.
Goods Damaged Upon Arrival
If any products delivered are damaged at the moment of delivery Bonds: Garages and Sheds will supply replacements providing they have not been signed for as 'received in good condition' and we have been notified within 3 days.
If goods have been signed for as 'received in good condition' Bonds: Garages and Sheds will not accept responsibility if these goods are later found to be damaged. If goods are not inspected at the time of delivery, please sign for as 'not inspected'.
In the event of goods being obviously damaged on arrival, please sign for the goods as 'damaged' and do not accept delivery. Please inform us within 48 hours to ensure we can look into the incident.
Returns Service:
We try our utmost to ensure all our orders arrive in perfect condition and have invested a lot of time and money into developing a packaging and delivery solution that achieves good results, time and time again. However, occasionally things still go wrong - if you feel that your order hasn't arrived in acceptable condition. please read below carefully.
Things to bear in mind.
Our buildings are made from steel. A steel panel or section may get slightly bent when being shipped. In most cases, these slight imperfections can simply be straightened without harm. It is possible that a section may be damaged beyond reason, in which case we will be happy to replace it.
If you feel that your order is in an unacceptable condition then we will be happy to help you further. To process your complaint we will need:
- Pictures of any damage to your order, and how this affects the whole piece. These can be emailed or posted to us on the details below;
- Your order number or name.
Failure to provide the above will result in a delay in handling any problems as quickly and efficiently as possible.
Returns Policy:
You are required to notify us within 3-days of receipt of your goods if your order arrives damaged in any way.
'Custom made', bespoke or 'made to order' items are only returnable in cases of faulty workmanship or incorrect manufacture, however, we will do all we can to remedy any problems, usually free of charge, only replacing goods if this is not possible.
Returns cannot be accepted if goods have been altered, assembled or customised in any way.
- For non-faulty goods, the cost of returning an unwanted item shall be met by the buyer;
- If your goods are faulty and returned under warranty we will pay for any reasonable postage costs (usually equivalent to 2nd class mail).
- We will not be held liable for any additional costs related to the installation or replacement of goods.
Installation Service
All our products are sold and supplied for self-assembly only unless otherwise stated.
If an installation service is requested, the customer must provide suitable access, and a flat and level base capable of carrying considerable weight.
The site should be clear of overhanging branches or obstructions and have sufficient unobstructed access (minimum 600mm) around the site for safe erecting and maintenance of the building. If access or the base is unsuitable, you will be liable for the aborted labour costs (10% of the product price), and the product will be left for self-assembly.
Should a return installation service be required, a charge will be made.
The customer must ensure that the installer's vehicle can be parked as close as possible to the installation site. If a parking area cannot be located near the site, the installation may be abandoned and a return charge may be made. The customer will be liable for any costs incurred by the installation team e.g. metered parking) during the installation period.
Liability
The customer should check before ordering that the building will be suitable for its intended purpose.
If we, (or our suppliers) are unable to supply your order, we will refund you in full as soon as possible. We will not be obliged to pay any compensation for disappointment or inconvenience.
We will not be liable for a) losses that were unforeseeable to both parties when the contract was made, b) losses that were not caused by any breach on the part of the supplier, c) business losses and/or losses to non-consumers.
In the event that we arrange an installation service, no liability for damage to property or belongings will be accepted if our installers are required to access the site through a house or property (commercial or residential). The customer should ensure that all floor coverings are protected, and any valuables or breakable objects have been removed from the thoroughfare.
Warranty
All products are guaranteed for a period of 12 months from the date of purchase. This is a parts-only guarantee, and no labour or installation costs are covered.
Force Majeure:
We shall have no liability to you for any failure to deliver goods you have ordered, any delay in doing so, for any damage, or a defect to goods delivered, that is caused by any event beyond our reasonable control. (Including, but not limited to, acts of God, governmental actions, war, national emergency, acts of terrorism, fire, explosion, flood, strikes, lockouts and other industrial disputes).
